These Terms & Conditions ("Agreement") govern your access to and use of the Esset property management platform ("Platform") operated by Eland Technologies ("Esset", "we", "us", or "our"). By creating an account or using the Platform, you ("Customer", "you") agree to be bound by this Agreement.
New customers may access the Platform free of charge for fourteen (14) days ("Trial Period"). No payment details are required to begin a trial. At the end of the Trial Period, your account will be paused. To continue using the Platform you must activate a paid Subscription. Trial data is retained for thirty (30) days after the Trial Period expires, after which it may be permanently deleted.
Subscriptions are available on monthly or annual billing cycles. Fees are charged in advance at the start of each billing period. All fees are stated exclusive of applicable taxes. Esset reserves the right to change pricing with thirty (30) days' written notice.
If a payment fails, your account will be locked immediately and access to the Platform suspended. Your Customer Data will be retained for thirty (30) days from the date of suspension to allow you to resolve the payment issue and restore access. If payment is not received within that thirty (30) day window, Esset may permanently delete your Customer Data. Esset will send written notice to your registered email before any deletion occurs.
You may cancel your Subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you will not be charged for the following period and will retain access until the period ends. No refunds are issued for the remainder of a billing period already paid.
You own your data. All Customer Data and Tenant Data remains your exclusive property at all times. Esset claims no ownership rights over any data you create, upload, or generate through the Platform. You grant Esset a limited, non-exclusive, royalty-free licence to host, store, process, and transmit Customer Data solely for the purpose of providing the Platform to you and as described in this Agreement and our Privacy Policy.
Esset will not access, use, or disclose your Customer Data except: (a) as necessary to provide the Platform; (b) as required by applicable law or a lawful order; or (c) with your explicit written consent.
Where the Platform is used to store or process personal data relating to your tenants, residents, or other third parties:
You are responsible for obtaining any consents, providing any notices, and meeting any other obligations required by applicable data protection law with respect to your tenants and users before entering their personal data into the Platform.
Esset targets a monthly uptime of 99.5% for the Platform, excluding scheduled maintenance, emergency maintenance, and any unavailability caused by factors outside Esset's reasonable control (including third-party infrastructure failures, internet outages, or force majeure events). Esset will use commercially reasonable efforts to provide advance notice of scheduled maintenance windows.
Esset does not guarantee uninterrupted or error-free operation of the Platform, and planned downtime will not be counted against the uptime target.
You agree to use the Platform only for lawful property management purposes. You must not:
All intellectual property rights in the Platform — including its software, design, algorithms, documentation, and trademarks — are and remain the exclusive property of Eland Technologies. This Agreement grants you a limited, non-exclusive, non-transferable licence to access and use the Platform during your Subscription. No other rights are granted.
You may optionally grant Esset a non-exclusive, royalty-free licence to display your company name and logo on Esset's website or marketing materials as a customer reference. This is entirely optional and may be withdrawn at any time by written notice to support@esset.io.
Each party agrees to keep confidential all non-public information received from the other party in connection with this Agreement that is designated as confidential or that reasonably should be understood to be confidential. Confidentiality obligations survive termination of this Agreement for a period of two (2) years.
You are responsible for ensuring the confidentiality of all Tenant Data within your organisation. You must implement appropriate access controls so that only authorised personnel can access sensitive data within the Platform.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Esset does not warrant that the Platform will be error-free, uninterrupted, or free of harmful components, or that any defects will be corrected.
To the maximum extent permitted by applicable law, Esset shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of or inability to use the Platform, even if advised of the possibility of such damages.
Esset's total aggregate liability to you for any and all claims arising under or in connection with this Agreement shall not exceed the total fees paid by you to Esset in the three (3) months immediately preceding the event giving rise to the claim.
Neither party shall be liable for any delay or failure to perform its obligations under this Agreement to the extent that such delay or failure is caused by events beyond that party's reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, civil unrest, government action, failures of third-party infrastructure providers (including cloud hosting providers), widespread internet outages, or cyberattacks on third-party systems. The affected party shall promptly notify the other and use reasonable efforts to minimise the impact and resume performance.
This Agreement commences on the date you first create an account (including a trial account) and continues for successive billing periods depending on your chosen plan, unless terminated earlier in accordance with this Agreement. Subscriptions automatically renew at the end of each billing period unless cancelled in advance via your account dashboard.
Confidentiality obligations continue for two (2) years following termination or expiry. Esset may update this Agreement from time to time with seven (7) days' written notice. Continued use of the Platform after notice constitutes acceptance of the updated terms.
Either party may terminate this Agreement immediately upon written notice if the other party:
Esset may also suspend or terminate your account immediately and without notice if your use of the Platform poses a security risk, violates applicable law, or is reasonably likely to cause harm to Esset or other customers.
Upon termination or expiry of this Agreement for any reason, your access to the Platform will cease. You will have thirty (30) days from the date of termination to export your Customer Data using the Platform's data export tools. After this window, Esset may permanently delete your Customer Data. Esset will send written notice to your registered email before deletion.
Sections 3 (Data Ownership), 8 (Intellectual Property), 9 (Confidentiality), 10 (Warranty Disclaimer), 11 (Limitation of Liability), and 16 (Governing Law) survive termination.
This Agreement shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute between the parties, unless amicably resolved, shall be submitted to the competent courts in Pakistan.
For customers located outside Pakistan, Esset and the Customer may agree in writing to resolve disputes through binding international arbitration under internationally recognised arbitration rules, in lieu of litigation in Pakistani courts.
